Terms of Service

1. Agreement to Terms

By creating an account, accessing, or using any GenXcd product (the "Service"), you agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy, incorporated herein by reference. These Terms constitute a legally binding agreement between you ("User") and GenXcd ("we," "us," or "our").

If you do not agree to these Terms, do not create an account or use the Service.

2. Description of Service

GenXcd develops and operates AI-powered SaaS applications including Psychic-OS, a practice management platform for metaphysical and holistic service providers. Services include appointment scheduling, client relationship management, session documentation, energy logs, and AI-assisted practice tools.

GenXcd reserves the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

3. Eligibility

To use our Service, you must:

  1. Be at least 18 years of age

  2. Have the legal capacity to enter into binding contracts

  3. Not be prohibited from using the Service under applicable law

  4. Provide accurate, current, and complete information during registration

4. Account Registration and Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activity that occurs under your account

  • Notifying us immediately at contact_us@genxcd.com if you suspect unauthorized access

GenXcd is not liable for any loss or damage arising from your failure to maintain account security. You may not create multiple accounts — duplicate accounts may be terminated without notice.

5. Acceptable Use

You agree NOT to:

  1. Use the Service for any illegal purpose or in violation of applicable laws

  2. Impersonate any person or entity

  3. Upload content that is harmful, offensive, threatening, or abusive

  4. Attempt to gain unauthorized access to any part of the Service

  5. Reverse engineer, decompile, or disassemble any part of the Service

  6. Use automated bots, scrapers, or similar tools to access or collect data

  7. Interfere with or disrupt the integrity or performance of the Service

  8. Upload content that infringes any intellectual property rights

  9. Use the Service to store or transmit malware or malicious code

  10. Resell, sublicense, or commercially exploit the Service without express written consent

6. Client Data and Privacy

When you use our Service to store information about your clients, you are the data controller for that information. You are responsible for obtaining necessary consents from your clients and complying with applicable privacy laws. GenXcd acts as a data processor and processes client data only on your instructions and in accordance with our Privacy Policy.

7. Intellectual Property
7.1 Our Intellectual Property

GenXcd products, brand, logos, software, and content are owned by or licensed to GenXcd and protected by applicable intellectual property laws. You may not use our intellectual property without express written permission.

7.2 Your Content

You retain ownership of all content you create and upload. By using the Service, you grant GenXcd a limited, non-exclusive, royalty-free license to store, process, and display your content solely to provide the Service to you.

7.3 Feedback

If you submit feedback or suggestions, you grant GenXcd the right to use that feedback without restriction or compensation.

8. Subscription, Billing, and Payments

  • Subscriptions are billed in advance on a recurring basis (monthly or annually)

  • By subscribing, you authorize GenXcd to charge your payment method on each billing date

  • Free trials automatically convert to paid subscriptions unless cancelled before trial expiry

  • Price changes will be communicated with at least 30 days' advance notice

  • You are responsible for all applicable taxes

  • Billing disputes must be submitted to contact_us@genxcd.com within 30 days of the charge

9. Termination
9.1 Termination by You

You may terminate your account at any time from within the app or by contacting contact_us@genxcd.com.

9.2 Termination by GenXcd

We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms, pose a security risk, or if we are required to do so by law.

9.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Your data will be retained for 30 days during which you may request an export, then permanently deleted.

10. Disclaimers

  • No Warranty: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

  • No Professional Advice: Nothing within the Service constitutes legal, financial, medical, or mental health advice.

  • Service Availability: We do not guarantee the Service will be available at all times or free from errors.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GENXCD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. GENXCD'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO GENXCD IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless GenXcd and its officers, employees, and agents from any claims, liabilities, damages, and expenses arising from your use of the Service, your violation of these Terms, or any content you submit.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved through binding arbitration under the American Arbitration Association's Consumer Arbitration Rules. Either party may seek injunctive relief in a court of competent jurisdiction in Austin, Texas.

14. Changes to Terms

We will notify you of material changes by email and/or in-app notice at least 14 days before changes take effect. Continued use after the effective date constitutes acceptance.
